ACCEPTABLE USE POLICY

1. Purpose
This Acceptable Use Policy (“AUP”) sets out the standards of conduct binding on all individuals and entities (“Users”) who access or use https://endngo.com (“Website”) and the services of MARKOEU OÜ (“Company”). This AUP is incorporated by reference into the Terms and Conditions and partially fulfils the Company’s obligations under Regulation (EU) 2022/2065 (Digital Services Act – “DSA”).
2. Permitted Use
Users may use the Website solely for: (a) lawful personal non-commercial purchase of Digital Products; (b) creation and management of their account; (c) accessing customer support; (d) submitting notices of suspected illegal content under Section 9 below.
Users are expected to act in good faith when using the Website and interacting with the Company.
3. Prohibited – Commercial Misuse
- Bulk purchasing of Game Keys for the purpose of commercial resale or secondary-market distribution, without prior written authorisation from the Company;
- Operating a resale, arbitrage, or key-trading business through or in connection with the Website without a formal written commercial agreement with the Company;
- Systematic purchase and resale of Game Keys to exploit regional price differentials;
- Accumulating excessive volumes of a single product for purposes other than legitimate personal use, taking into account normal consumer behaviour and purchasing patterns.
4. Prohibited – Fraud and Financial Crime
- Use of stolen, cloned, or otherwise unauthorised payment credentials;
- Initiating payment chargebacks or reversals without legitimate grounds and without first notifying the Company;
- Conduct connected with money laundering, terrorist financing, or the evasion of applicable financial sanctions;
- Structuring transactions in a manner designed to circumvent automated monitoring thresholds;
- Providing false, inaccurate, or misleading information at registration or during identity verification.
5. Prohibited – Impersonation and Deception
- Impersonating MARKOEU OÜ, the “endngo” brand, its director, employees, or representatives;
- Registering domain names, social media accounts, or email addresses designed to impersonate or deceive in connection with the Company’s brand;
- Misrepresenting professional, media, press, or content-creator status to obtain Game Keys, credits, or discounts under false pretences;
- Transmitting deceptive or phishing communications to other Users through any Website channel.
6. Prohibited – Technical Abuse
- Accessing the Website using automated scripts, bots, crawlers, or scrapers not expressly authorised by the Company;
- Circumventing rate-limiting, velocity controls, or purchase quantity restrictions;
- Conducting security or penetration testing of the Website without prior written authorisation;
- Introducing malware, ransomware, spyware, or any other harmful code;
- Conducting denial-of-service or resource exhaustion attacks;
- Bypassing authentication mechanisms, access controls, or security features;
- Use of VPNs or similar tools for the purpose of circumventing regional restrictions, pricing, or compliance controls is prohibited.
7. Prohibited -Account and Identity Integrity
- Maintaining more than one registered account for the same individual;
- Transferring or sharing account access for commercial benefit;
- Misrepresenting affiliation with any publisher, developer, or platform operator.
8. Prohibited – Intellectual Property
- Reproducing, distributing, or creating derivative works from Website content without prior written authorisation;
- Removing or altering copyright notices, trademarks, or proprietary markings;
- Uploading or transmitting content that infringes the intellectual property or privacy rights of any third party.
9. Minors and Age-Restricted Content
Users must not purchase or facilitate access to age-restricted products (rated PEGI 18 or equivalent) on behalf of persons under the age of eighteen (18). The Company reserves the right to require age verification before fulfilling orders for age-restricted products.
10. Illegal Content – Reporting Mechanism (DSA Article 16)
Any person may notify the Company of content on the Website that they believe to be illegal by contacting [email protected] and providing: (a) the legal basis for the alleged illegality; (b) the URL or other means of identifying the reported content or product; and (c) contact details of the reporter (anonymous reports are accepted but cannot receive individual feedback). The Company will process all notices in a diligent, timely, and non-arbitrary manner. Reports from entities designated as “trusted flaggers” by the Estonian Digital Services Coordinator will be prioritised.
11. Enforcement
11.1 Monitoring
The Company may monitor usage of the Website to the extent necessary to ensure compliance with this Policy, prevent fraud, and maintain security..
11.2 Consequences of Breach
Breaches of this AUP may result in, without limitation: immediate account suspension or permanent termination (with a statement of reasons provided per Article 17 DSA where legally permissible); cancellation of pending Orders without refund where fraud or sanctions risk is substantiated; reporting to the Estonian FIU, police, or other competent regulatory authorities; civil proceedings; and permanent blacklisting of associated payment methods. Enforcement measures are applied in a proportionate and case-specific manner, taking into account the severity and context of the breach.
11.3 Appeals
Users may appeal enforcement decisions free of charge by writing to [email protected]. DSA-certified out-of-court settlement bodies designated by the Estonian TTJA are also available.
